The state line is fixed at the northern low-water mark as it existed in 1792 (when Kentucky became a state), meaning most of the water and the riverbed belong to Kentucky rather than to Ohio, Indiana, or Illinois.This quirk dates back to Colonial America. Virginia originally owned the river, and when it granted statehood to Kentucky in 1792, those river rights were transferred. Even though Ohio challenged this in the U.S. Supreme Court, the court repeatedly ruled in Kentucky’s favor, confirming that Kentucky’s jurisdiction extends all the way to the historical northern shore.
